Not entirely sure this is the issue, but this would be my theory.
eDiscovery is based on Search. By default personal files in your MySite (SkyDrive Pro) are exempt from being crawled and added to the index. If they aren't added to the index they aren't searchable or eDiscoverable. Try changing the library settings on your personal MySite to include the files in the index and see if they don't show up as discoverable after the next crawl.
From my experience eDiscovery still respects security trimming. So the person who runs the eDiscovery needs to have at least read permission to the files otherwise they won't be able to see them.
The documents need to indexed and you need to have correct permissions.

this is not the issue, I can perform a crawl on mysites, I can see the content was crawled. I can do a search and find the content.
I can't add http://mysites as a location for an ediscovery query. I receive the following error when I try and add the mysite url as a sharepoint location "No exact match was found. The URL may be invalid, ou don't have permission to access this location, or the location is not indexewd by search.
URL works, Permissions are not the issue.
It will let me add each personal site collection, we have over 1000. http://mysite/personal/username
So why will it let me add other Web Applications and search all of the site collections, but it treats a Mysite host web app differently?
